None of the wording in the Amendments of the Bill of Rights have ever had their wording changed. The BOR: amends the Constitution. Which also has never had its wording changed. Not to be confused with Amendments to the Bill of Rights and the Constitution DO change the meaning of those documents as a whole when read together but the words are not changed........only superseded. Not overturned, and not bound by stare decisis.

You are confused with contract law or specific defined information legislation. If I voluntarily take a job or government position and there is a clause or existing legislation restricting me from speaking to Russians, that is contract law. If I am aware of the range of the new F-35 fighter and tell the Russians, that is covered by a variety of acts including the Espionage Act.

You side with authoritarians on every issue and don't have a clue why freedom of speech is the most important human right and a requirement for obtaining justice.

13 state constitution/founding documents had no BOR that I am aware of. 13 state whatevers have nothing to do with the Federal Gubment. You really are conflating entirely different things.

Const/BOR is not legislation as commonly thought of.......how could it be as there is no legislature. Its the difference between "founding" documents and what comes thereafter.

You should have done some research then. The individual 13 States incorporated the UK 1689 Bill of Rights as colonies of the UK with a monarch.

Of relevant note during my travels "off base" around the world I accepted the fact that I could be killed by anyone upset enough to do so over USA policy overseas. All part of the gig. It was never a real "perceived" issue except once on the last day or two of the Shah of Irans evacuation from Tehran. I'm not sure who those guys walking around in brown uniforms with automatic weapons were but they gave us a long stare stink eye the whole time we were on the ground. I'm sure some of those boxes we took out contained gold and jewels?

In court, a prosecution or defense case is presented to the judges, where many separate precedent cases are submitted and the facts that apply to those separate cases. There are then applied to THE MATTER AT HAND and woven together to match the facts or law in dispute of the MATTER AT HAND.

The Supreme Court may make a majority decision for the MATTER AT HAND based on the "commonlaw" (judge made law). However an applicant to the Supreme court may make an appeal based on EQUITY LAW precedents and advocate that the commonlaw forced an absurb or inequitable decision on the Supreme Court for the MATTER AT HAND. The Supreme Court would then hear applications introducing individual precedent cases of EQUITY LAW and overturn their earlier decision. The individual precedent cases that were previously submitted in the first hearing and subsequent appeal, all remain valid as the Supreme Court is bound by stare decisis. The new ruling of the Supreme Court is additional to those existing cases and only applies to the exact facts of the MATTER ON HAND.

If you ever bothered to pick up a basic book on law you would have realised hat If all the individual precedent cases, used in submissions, are overturned by the Supreme Court, then every court case in USA history would suddenly be able to be appealed. That's why the Supreme Court has to follow Stare Decisis

How can there only be common law if there is the legislation of the United States Articles of Confederation?

Well....in the USA the Supremes don't make factual findings they only deal with legal issues. In your case as described "the law" was not overturned....equity still applies. You are confusing legal issues with factual issues.

According to the Wiki: you've been totally confusing Trial courts that are called Supreme Courts with Appellate Courts that are called High Courts. In USA Trial courts are most often called Superior Courts and our High Court is called the Supreme Court. What you posted makes more sense now, ....................
